Legal risk is the biggest concern in Vietnamese property transactions. Understanding these documents helps you avoid costly disputes.
1. Land Use Right Certificate (Pink Book)
This is the most important document, certifying land use rights and home ownership. Verify owner information, area, land use purpose, and term. Never transact on property without this certificate.
2. Check Zoning Plans
Visit the district People’s Committee or planning portals to confirm the land is not subject to suspended planning, clearance orders, or public utility protection corridors.
3. Verify Disputes and Mortgages
Ask the land registration office to confirm the property is free of seizure orders, bank mortgages, or ongoing litigation. Any transaction on mortgaged assets carries high risk.
4. Notarized Sale Contract
Property transactions must be notarized at a notary office. Never sign handwritten agreements or authorizations in place of a sale contract — their legal validity is completely different.
5. Tax Obligations
Sellers pay 2% personal income tax on the transfer value; buyers pay 0.5% registration fee. Agree clearly on who bears these costs before signing.
Minh Tam Land provides free legal due diligence for every transaction, giving clients absolute peace of mind.
